Q: Sold car to in-laws, they have not changed the plates yet….?
We recently purchased a new car for my wife and sold her old car to my in-laws. This was in May and we both signed a bill of sale and the title was signed over to them. Now, we never thought to take the plates off the car (which we should have done) — assuming they would get new plates. We got a nifty little letter in the mail from the Illinois Tollway Authority with a photo of our old car — three toll violations at $20 a pop..$ 61.50 please.
Granted, we don’t own this car any more but the plates are in our name. I told my wife I’m just going to pay this and have them pay us back…. Does anyone know what happens if I don’t pay this, considering we don’t own the car anymore? I don’t want my license suspended because of this considering my name is on these license plates.

Also, what happens with the Emissions Test? They sent us a letter stating the car is due for an emissions test.

A: You broke the 2 cardinal sins of selling your vehicle:
1) Never sell your vehicle to a family member or friend
2) Never leave your plates and registration with the vehicle you sell.

Your in-laws have never registered the vehicle, so in the eyes of the law it is still yours and they are borrowing it.

Therefore, you are responsible for the toll fines and will need to pay them to avoid any consequences of not paying.

Same goes for the emissions testing – If you don’t get it to pass emissions, then you will lose your license.

I suggest you get in touch with your in-laws as soon as possible to straighten it out.

In order to get your money from the tolls back, you will need to ask your in-laws for it. If they refuse, you will be forced to take them to small claims court where you will need a copy of the bill of sale or title proving you sold the car prior to the dates the fines were incurred.

Q: Should my husband and I buy a $101,000 tiny home (in a very nice neighborhood)?
We rent and hate it. There’s a very small home for sale close to both of our places of employment and it’s only $101K. It has 3 BR and 1 Bath and a 2 car garage. No basement (we live in Illinois so those are precious), but we’ve lived without before. We currently pay $850 a month for rent in a townhouse that is subpar, but bigger than the home. We both have substantial student and car debt, however, we desperately want to quit renting. We have great credit scores and can be approved for a decent loan. No down payment though. We talked to an advisor who said it would be about $650 per month (with property taxes added in) mortgage payment. Is it worth it???

Q: 04 Mazda 3s, Sounds like a scam to me.. what do you guys think?
This guy said he was going to sell me his 04 Mazda 3s for $4000, and I asked “why so cheap” (BY THE WAY, I LIVE IN ILLINOIS), he said

I am very glad that you interested in buying my car( 2004 Mazda Mazda3 S ).I am selling this car because my platoon has been sent back to Iraq and don’t want it get old in my backyard. The price is low because I need to sell it before March 12.It has no damage, no scratches or dents, no hidden defects. It is in immaculate condition, meticulously maintained and hasn’t been involved in any accident..I do have the title, clear, under my name. It is still available for sale if interested, price as stated in the ad $4000. A: personally i think buying cars off ebay is a bad idea. i personally know someone who scammed a bunch or people over ebay who thought they were getting a hummer, sent him the money, then never got their car. needless to say, he was in jail for a long time.
so dont trust it!

Q: Do I have to pay sales taxes again on a vehicle I leased in another state if I moved to a new state?
I leased my car last year in Indiana and registered/titled it in that state. I now live in the state of Illinois, but I do not want to get stuck paying a sales tax on my vehicle again.

My understanding is that Indiana incorporates the taxes due into your monthly lease payments. If I have to pay a sales tax to the state of Illinois I would be paying two different states a tax on the car. This doesn’t seem correct to me.

I have an Illinois drivers license because I lived in Illinois in 2005. I never changed the license because it doesn’t expire until 2010. I was able to register my car in Indiana without an Indiana driver’s license.

What do I have to do to ensure I don’t end up paying a tax twice?
Moreover, for the state of Illinois, do they require you to pay a sales tax on an out-of-state leased vehicle?

(The car cost $17,000 and by the end of the lease with my monthly payments, I will have only had to pay $9,100 of that total.)

A: No sure about your state, here you have to pay more taxes IF the taxes you paid were less than what you would have paid here. So if you paid 2% sales tax and they registered it here where tax is 6% then you would have to pay 4%

Q: Should my sister turn in her car or have it repossed?
Hello all, i have my sister living with me at the moment because of a fire, and i am happy to have her with me. While i am doing my best to open my home and anything extra i can spare for expenses, i am sadly not able to to help her financially with her car payment. It’s a whopping 400 bucks a month and its just not possible for me at the moment. :(

Anyway, my sister is 12 payments away from owning the car, and is about 2 or maybe 3 months late on her account. So my question is, how do we go about giving the car back or do we let the bank come and REPO it? She has decided to just give the car back as she is not working at the moment, and i cannot help her. As far as plans for filing for bankruptcy, i am assuming that she may be, cannot tell for sure.

And once the car is back in the possession of the lenders, do they sell it and then bill her for the amount owed after the sale? Any help would be great!

There is also no need for rude snarky comments, i am not looking for your opinions, i would just appreciate the facts, thank you!

A: Either way, the banks is going to repossess the car. They do give you a little time to try and get the car back by paying what’s owed, but if you don’t they will sell the car at auction. Unfortunately, they won’t sell it for a lot and your sister will be responsible for the difference. When my car got repossessed, I owed 8,000 on it. They only sold the car for $800. And with lawyer’s fees added on I paid back over 5 years nearly 10,000. Tell your sister good luck.

Q: What is the worse out come credit and cash wise to car repo and foreclosed house at the same time?
I lost my job in illinois. The only work i could find that was close to the same pay was out of state. I have had my home for sale for 3 months, and not even one offer. Im approved for short sale and advertising it as well. If I go through a foreclosure should I also have my car repo’d. I am not making the money I need anymore after the job loss. with that being said, a foreclosed house will kill my credit should i just cut all my losses and get rid of my high car payment as well and then just save cash for 5-7 years for a new home. I do know that I will have to repay any monies owed on the car after I turn it in as well. Solid advice is really helpful.
I am in fear of losing my house due to job loss. If that reports on my credit should i have my car repo at the same time since my credit is going to be suffering for the next 7 years. I will be able to save some money by not paying my car payment.

A: First, the house – this is probably your most valuable asset. Do what you can to protect it or at least avoid foreclosure.

Can you get the job out of state and rent the house?
What strategy are you using to sell the house? Do you a real estate agent? Is it being staged properly (ie. clean inside, good landscaping)? How is it priced?

How you spoken to a HUD approved housing counselor?

You have to avoid foreclosurer!

As for the car, if you can afford it – meaning you don’t have to come up with cash to get rid of it – unload it now.

Q: i recently bought a car but lost title before it was registered….HELP!!!?
i bught a car in missouri…saved up for a down payment and the whole time was under the influence that the dealer was taking care of tax,title and lisence…2 months later i finally got a bill of sale with said title. I called and he said that i had to take care of them myself and basically gave me a run around about he didnt lie(fine print bullcrap, he a sleezball)..anyways my wife has a habit of throwing away everything…and she threw away my title before it was even registered to my name..i live in illinois…what do i do do?

A: If you don’t have a title, you have a car you can’t put in your name or register, so for now, park it. Contact the dealer and tell him you lost the title, and offer to pay for getting a duplicate.

If you can’t do that, there is the concept of bonded title, but it’s both complicated and expensive, and should be only used as a last resort.

Q: How do I get a title and registration for a moped with missing title?
I live in Illinois and want to buy a moped to save on gas and because I had one in college and it was a blast. A lot of the cool older ones I see on ebay have missing titles, but the listings all say you can get it titled and registered with a bill of sale.

A friend of mine tried this in New Mexico with a car, they would not title and register the car until he found the original title.

Anyway, my question is: If I buy a moped that has a missing title, is there some way I can get it titled and registered so I can ride it?

A: Yeah, well, they’re trying to SELL you something.

It’s damned hard to do what you need to do, when you buy something without a title. You have to file bonds, affidavits, pay fees, and frequently, the item is a stolen item, and will be taken back from you.

At the very least, this is going to cost you hundreds extra, and take maybe six months to work the paperwork out. It’s likely NOT worth the hassle.

Q: If I buy something in one state from a business that is another state do I have to pay sales tax on it?
I live in Illinois and bought a part for my car over the phone from a junkyard in Indiana. The part is going to be shipped to me. But I was charged a tax on it by the yard. Do I need to pay this tax since I bought it from a different state? I am asking because I have observed that tax is not charged in this situation, i.e. items that are bought on Ebay by someone who lives in a different state than the business that is selling an item.

A: Only if the other state charges sales tax.

Q: SUB-LEASING? I’ve been approached by an agent from “automotions concepts” and I need to know if they are legit
I am trying to sell my car and was approached by “automotions concepts inc” -> they are located out of illinois. i cannot afford a lawyer to look at the sample contracts he provided but the sales agent seems to be honest. basically from what i understand, they are sub-leasers and the find clients, in my case, to take over my payments but i will get a balloon payment in the end for it. but i had requested that i need the money upfront and he was able to find a client that was able to meet my needs (an upfront payment). basically the agreement is that the client will make guaranteed payments for the car….. im the lessor. i guess they’re just the 3rd party that the client pays a fee to for finding the car.

im just clueless and don’t know if i should take this route. i need to sell my car.

If you can’t afford a lawyer to review the contract, can you afford to NEVER see the car again while you don’t get any payments and still have to make payments on it?? Didn’t think so!

Of course the dude “seems to be honest.” That’s now scam artists work!
